End-User License Agreement (EULA)
This End-User License Agreement (“Agreement”) is a binding contract between you (“User”) and Kittap.App (the “Company”) governing your use of the Kittap.App mobile and web application (the “App”). By installing, accessing, or using the App, you agree to be bound by this Agreement.
Kittap.App is operated by Kita Platform LTD, and references to the Company in this Agreement mean Kita Platform LTD. If you do not agree with any part of this Agreement, you must not install or use the App.
1. License Grant
The Company grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App for personal, non-commercial purposes only. This license is subject to your compliance with this Agreement and applies to your use of the App on your compatible devices.
2. Restrictions
You may not:
- Modify, translate, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, sublicense, or transfer rights to the App
- Use the App in ways that infringe third-party rights or violate applicable laws
- Remove or alter proprietary notices, trademarks, or labels
- Copy or adapt the App
- Otherwise attempt to discover the source code, underlying ideas, or algorithms of the App
- Lend, sell, or distribute the App
You also may not permit others to do any of these things.
3. User Accounts & Security
- You must provide accurate account information when registering
- You are responsible for maintaining the confidentiality of your credentials
- You must report unauthorized account use to hello@kitaplatform.com immediately
- You may need to register for an account to use some features of the App
- You must keep your account information current and complete
4. User-Generated Content & Community Guidelines
The App allows you and other users to post, upload, publish, and share content, including text, photos, audio, and video (“User Content”).
- Content must not be illegal, offensive, defamatory, obscene, pornographic, or abusive
- Automated filters and moderators review flagged content within 24 hours
- Harassment and hate speech result in account suspension or termination
- You retain ownership of content you create, but grant the Company a worldwide, royalty-free license to display it within the App and related services
- You can flag or report any User Content that you believe breaks these rules by using the Report option in the App
- We moderate User Content and may remove any content that violates this Agreement
- Action on flagged content that breaks these rules can include removing the content and suspending or terminating the account of the user who posted it
- We have no tolerance for objectionable content or abusive users. Threats and other abusive behavior are prohibited, in the same way as harassment and hate speech
- Users who repeatedly break these rules are permanently removed from the App
5. Live Streaming to YouTube
When you connect a YouTube account to broadcast from Kittap.App, you:
- Authorize Kittap.App to create live broadcasts, stream media, and read/send chat messages on your behalf
- Remain fully responsible for all content you broadcast, including compliance with YouTube's Terms of Service and Community Guidelines
- May revoke access at any time via Google Account permissions
6. Auto-Renewable Subscriptions
- Monthly or annual premium subscriptions are available
- Subscriptions auto-renew unless canceled at least 24 hours before the renewal date
- Cancellation is managed through your Apple ID or Google Play subscription settings
- No refunds are issued for unused portions except as required by law
- The name, length, and price of each subscription are shown on the purchase screen before you buy; prices can vary by country or region
- Payment is charged to your Apple ID or Google Play account when you confirm the purchase or, if a free trial is offered, when the trial ends
- Your account is charged for renewal within 24 hours before the end of the current period, at the renewal price shown in your subscription settings
- You can manage your subscription and turn off auto-renewal at any time after purchase in your Apple ID or Google Play account settings
- If a free trial is offered, any unused part of the trial is forfeited when you buy a subscription
7. Privacy Policy
Your use of the App is also governed by our Privacy Policy.
8. Intellectual Property
All rights, title, and interest in the App, including all related intellectual property, remain with the Company or its licensors. These rights include the trademarks, logos, and proprietary information in the App. This Agreement does not grant you any rights in connection with any trademarks or service marks of the Company.
9. Termination
The Company may terminate this Agreement and your access to the App immediately, without prior notice, for any breach of this Agreement or misuse of the service. Upon termination, you must stop all use of the App and delete all copies of it from your devices.
10. Disclaimers
The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied. The Company disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company does not warrant that the App will be error-free, uninterrupted, or completely secure.
11. Limitation of Liability
The Company shall not be liable for indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the App, even if advised of the possibility of such damages. This limitation applies to the maximum extent permitted by law and also covers the Company's officers, directors, employees, and agents.
12. Governing Law & Dispute Resolution
This Agreement is governed by the laws of Ireland. Any disputes shall be resolved in the courts of Dublin, Ireland. This choice of law applies without regard to conflict of law principles.
13. Changes to This Agreement
We may update this Agreement from time to time. Changes update the “Last updated” date, and your continued use of the App after such changes constitutes acceptance of the updated Agreement.
14. Apps Downloaded from the Apple App Store
If you downloaded the App from the Apple App Store, the following terms also apply. If they conflict with any other part of this Agreement, this section applies.
- Acknowledgement: This Agreement is concluded between you and the Company only, and not with Apple Inc. (“Apple”). The Company, not Apple, is solely responsible for the App and its content. This Agreement does not set usage rules for the App that conflict with the Apple Media Services Terms and Conditions.
- Scope of license: The license granted in section 1 is a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the App may also be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing.
- Maintenance and support: The Company is solely responsible for providing any maintenance and support services for the App, as described in this Agreement or as required under applicable law. You and the Company acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services for the App.
- Warranty: The Company is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the Company's sole responsibility.
- Product claims: You and the Company acknowledge that the Company, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of the App, including (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. Nothing in this Agreement limits the Company's liability to you beyond what applicable law permits.
- Intellectual property rights: You and the Company acknowledge that, if a third party claims that the App or your possession and use of the App infringes that third party's intellectual property rights, the Company, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer contact: Questions, complaints, or claims about the App should be directed to Kita Platform LTD by email to hello@kitaplatform.com or through kittap.app/support.
- Third-party terms: You must comply with applicable third-party terms of agreement when using the App, for example the terms of your mobile data service.
- Third-party beneficiary: You and the Company acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and that, upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.

Son Kullanıcı Lisans Sözleşmesi (EULA)
Bu Son Kullanıcı Lisans Sözleşmesi (“Sözleşme”), Kittap.App mobil ve web uygulamasını (“Uygulama”) kullanımınızı düzenleyen, sizinle (“Kullanıcı”) Kittap.App (“Şirket”) arasında yapılmış bağlayıcı bir sözleşmedir. Uygulamayı yükleyerek, Uygulamaya erişerek veya Uygulamayı kullanarak bu Sözleşmeyle bağlı olmayı kabul edersiniz.
Kittap.App, Kita Platform LTD tarafından işletilir ve bu Sözleşmedeki Şirket ifadesi Kita Platform LTD’yi ifade eder. Bu Sözleşmenin herhangi bir bölümünü kabul etmiyorsanız Uygulamayı yüklememeli ve kullanmamalısınız.
1. Lisans Verilmesi
Şirket, Uygulamayı yalnızca kişisel ve ticari olmayan amaçlarla yüklemeniz ve kullanmanız için size sınırlı, münhasır olmayan, devredilemez ve geri alınabilir bir lisans verir. Bu lisans, bu Sözleşmeye uymanıza bağlıdır ve Uygulamayı uyumlu cihazlarınızda kullanmanızı kapsar.
2. Kısıtlamalar
Şunları yapamazsınız:
- Uygulamayı değiştirmek, çevirmek veya Uygulamadan türev çalışmalar oluşturmak
- Uygulamada tersine mühendislik yapmak, Uygulamayı kaynak koda dönüştürmek (decompile) veya parçalarına ayırmak (disassemble)
- Uygulamaya ilişkin hakları kiralamak, finansal kiralama yoluyla kullandırmak, alt lisans vermek veya devretmek
- Uygulamayı üçüncü kişilerin haklarını ihlal edecek veya yürürlükteki kanunlara aykırı olacak şekilde kullanmak
- Mülkiyet bildirimlerini, ticari markaları veya etiketleri kaldırmak ya da değiştirmek
- Uygulamayı kopyalamak veya uyarlamak
- Uygulamanın kaynak kodunu, temelindeki fikirleri veya algoritmaları başka bir yolla ortaya çıkarmaya çalışmak
- Uygulamayı ödünç vermek, satmak veya dağıtmak
Başkalarının bunlardan herhangi birini yapmasına da izin veremezsiniz.
3. Kullanıcı Hesapları ve Güvenlik
- Kayıt olurken doğru hesap bilgileri vermelisiniz
- Oturum açma bilgilerinizin gizliliğini korumaktan siz sorumlusunuz
- Hesabınızın yetkisiz kullanımını derhal hello@kitaplatform.com adresine bildirmelisiniz
- Uygulamanın bazı özelliklerini kullanmak için bir hesap oluşturmanız gerekebilir
- Hesap bilgilerinizi güncel ve eksiksiz tutmalısınız
4. Kullanıcı İçeriği ve Topluluk Kuralları
Uygulama, sizin ve diğer kullanıcıların metin, fotoğraf, ses ve video dahil içerik (“Kullanıcı İçeriği”) paylaşmasına, yüklemesine ve yayımlamasına olanak tanır.
- İçerik yasa dışı, saldırgan, karalayıcı, müstehcen, pornografik veya taciz edici olmamalıdır
- Otomatik filtreler ve moderatörler işaretlenen içeriği 24 saat içinde inceler
- Taciz ve nefret söylemi, hesabın askıya alınması veya kapatılmasıyla sonuçlanır
- Oluşturduğunuz içeriğin sahibi siz olmaya devam edersiniz, ancak Şirkete bu içeriği Uygulamada ve ilgili hizmetlerde göstermesi için dünya çapında geçerli, bedelsiz bir lisans verirsiniz
- Bu kuralları ihlal ettiğini düşündüğünüz her Kullanıcı İçeriğini Uygulamadaki raporlama seçeneğiyle işaretleyebilir veya bildirebilirsiniz
- Kullanıcı İçeriğini denetleriz ve bu Sözleşmeyi ihlal eden her içeriği kaldırabiliriz
- Bu kuralları ihlal eden işaretlenmiş içerik için alınan önlemler, içeriğin kaldırılmasını ve içeriği paylaşan kullanıcının hesabının askıya alınmasını veya kapatılmasını içerebilir
- Sakıncalı içeriğe ve taciz edici kullanıcılara hiçbir şekilde tolerans göstermeyiz. Taciz ve nefret söyleminde olduğu gibi, tehditler ve diğer taciz edici davranışlar da yasaktır
- Bu kuralları tekrar tekrar ihlal eden kullanıcılar Uygulamadan kalıcı olarak çıkarılır
5. YouTube’da Canlı Yayın
Kittap.App üzerinden yayın yapmak için bir YouTube hesabı bağladığınızda:
- Kittap.App’e sizin adınıza canlı yayın oluşturma, medya aktarma ve sohbet mesajlarını okuma ve gönderme yetkisi verirsiniz
- YouTube Hizmet Şartları ve Topluluk Kuralları’na uyum dahil, yayınladığınız tüm içerikten tamamen siz sorumlu olursunuz
- Bu erişimi dilediğiniz zaman Google Hesabı izinleri sayfasından iptal edebilirsiniz
6. Otomatik Yenilenen Abonelikler
- Aylık veya yıllık premium abonelikler sunulmaktadır
- Abonelikler, yenileme tarihinden en az 24 saat önce iptal edilmedikçe otomatik olarak yenilenir
- İptal işlemi Apple Kimliğinizin veya Google Play’in abonelik ayarlarından yönetilir
- Kanunun gerektirdiği durumlar dışında, kullanılmayan süreler için geri ödeme yapılmaz
- Her aboneliğin adı, süresi ve fiyatı, satın almadan önce satın alma ekranında gösterilir; fiyatlar ülkeye veya bölgeye göre değişebilir
- Ödeme, satın alma işlemini onayladığınızda veya ücretsiz deneme sunuluyorsa deneme sona erdiğinde Apple Kimliğinizden veya Google Play hesabınızdan tahsil edilir
- Yenileme ücreti, mevcut dönemin bitiminden önceki 24 saat içinde, abonelik ayarlarınızda gösterilen yenileme fiyatı üzerinden hesabınızdan tahsil edilir
- Satın aldıktan sonra aboneliğinizi dilediğiniz zaman Apple Kimliğinizin veya Google Play hesabınızın ayarlarından yönetebilir ve otomatik yenilemeyi kapatabilirsiniz
- Ücretsiz deneme sunulmuşsa, abonelik satın aldığınızda deneme süresinin kullanılmayan kısmı sona erer
7. Gizlilik Politikası
Uygulamayı kullanımınız ayrıca Gizlilik Politikamıza tabidir.
8. Fikri Mülkiyet
İlgili tüm fikri mülkiyet dahil olmak üzere Uygulama üzerindeki tüm haklar, mülkiyet ve menfaatler Şirkette veya lisans verenlerinde kalır. Bu haklar, Uygulamadaki ticari markaları, logoları ve özel bilgileri de kapsar. Bu Sözleşme, Şirketin ticari markaları veya hizmet markaları üzerinde size herhangi bir hak vermez.
9. Fesih
Şirket, bu Sözleşmenin herhangi bir ihlali veya hizmetin kötüye kullanılması halinde, bu Sözleşmeyi ve Uygulamaya erişiminizi önceden bildirimde bulunmaksızın derhal sona erdirebilir. Fesih halinde Uygulamayı kullanmayı tamamen bırakmalı ve Uygulamanın tüm kopyalarını cihazlarınızdan silmelisiniz.
10. Garanti Reddi
Uygulama, açık veya örtülü hiçbir garanti verilmeksizin “OLDUĞU GİBİ” ve “MEVCUT OLDUĞU ŞEKLİYLE” sunulur. Şirket; ticari elverişlilik, belirli bir amaca uygunluk ve hak ihlali bulunmamasına ilişkin tüm garantileri reddeder. Şirket, Uygulamanın hatasız, kesintisiz veya tamamen güvenli olacağını garanti etmez.
11. Sorumluluğun Sınırlandırılması
Şirket, bu tür zararların olasılığı kendisine bildirilmiş olsa bile, Uygulamayı kullanımınızdan kaynaklanan veya bununla ilgili dolaylı, arızi, sonuç niteliğindeki, özel veya cezai zararlardan sorumlu değildir. Bu sınırlama, kanunun izin verdiği azami ölçüde uygulanır ve Şirketin yöneticilerini, direktörlerini, çalışanlarını ve temsilcilerini de kapsar.
12. Uygulanacak Hukuk ve Uyuşmazlıkların Çözümü
Bu Sözleşme İrlanda kanunlarına tabidir. Tüm uyuşmazlıklar İrlanda’nın Dublin mahkemelerinde çözülür. Bu hukuk seçimi, kanunlar ihtilafı kuralları dikkate alınmaksızın uygulanır.
13. Bu Sözleşmedeki Değişiklikler
Bu Sözleşmeyi zaman zaman güncelleyebiliriz. Değişiklikler “Son güncelleme” tarihini günceller ve bu değişikliklerden sonra Uygulamayı kullanmaya devam etmeniz, güncellenmiş Sözleşmeyi kabul ettiğiniz anlamına gelir.
14. Apple App Store’dan İndirilen Uygulama
Uygulamayı Apple App Store’dan indirdiyseniz aşağıdaki koşullar da geçerlidir. Bu koşullar bu Sözleşmenin başka bir bölümüyle çelişirse bu bölüm uygulanır.
- Kabul: Bu Sözleşme Apple Inc. (“Apple”) ile değil, yalnızca sizinle Şirket arasında yapılmıştır. Uygulamadan ve içeriğinden Apple değil, yalnızca Şirket sorumludur. Bu Sözleşme, Uygulama için Apple Media Services Hüküm ve Koşulları ile çelişen kullanım kuralları öngörmez.
- Lisansın kapsamı: 1. bölümde verilen lisans, Uygulamayı sahip olduğunuz veya kontrolünüzde bulunan Apple markalı ürünlerde, Apple Media Services Hüküm ve Koşulları’nda yer alan Kullanım Kuralları’nın izin verdiği şekilde kullanmanız için verilmiş devredilemez bir lisanstır; ancak satın alan kişiyle Aile Paylaşımı veya toplu satın alma yoluyla ilişkilendirilmiş diğer hesaplar da Uygulamaya erişebilir ve Uygulamayı kullanabilir.
- Bakım ve destek: Uygulamaya ilişkin bakım ve destek hizmetlerini bu Sözleşmede belirtildiği şekilde veya yürürlükteki kanunun gerektirdiği ölçüde sağlamaktan yalnızca Şirket sorumludur. Siz ve Şirket, Apple’ın Uygulamaya ilişkin hiçbir bakım ve destek hizmeti sağlama yükümlülüğü bulunmadığını kabul edersiniz.
- Garanti: Etkili bir şekilde reddedilmemiş olduğu ölçüde, açık veya kanundan doğan örtülü tüm ürün garantilerinden yalnızca Şirket sorumludur. Uygulamanın geçerli herhangi bir garantiye uymaması halinde Apple’a bildirimde bulunabilirsiniz ve Apple, Uygulamanın satın alma bedelini size iade eder. Yürürlükteki kanunun izin verdiği azami ölçüde, Apple’ın Uygulamaya ilişkin başka hiçbir garanti yükümlülüğü yoktur ve herhangi bir garantiye uyulmamasından kaynaklanan diğer tüm talepler, kayıplar, yükümlülükler, zararlar, maliyetler veya giderler yalnızca Şirketin sorumluluğundadır.
- Ürün talepleri: Siz ve Şirket; (i) ürün sorumluluğu talepleri, (ii) Uygulamanın yürürlükteki herhangi bir yasal veya düzenleyici gerekliliğe uymadığına ilişkin talepler ve (iii) tüketicinin korunması, gizlilik veya benzeri mevzuattan doğan talepler dahil olmak üzere, Uygulamaya veya Uygulamaya sahip olmanıza ve Uygulamayı kullanmanıza ilişkin sizin veya üçüncü kişilerin taleplerini karşılamaktan Apple’ın değil Şirketin sorumlu olduğunu kabul edersiniz. Bu Sözleşmedeki hiçbir hüküm, Şirketin size karşı sorumluluğunu yürürlükteki kanunun izin verdiğinin ötesinde sınırlamaz.
- Fikri mülkiyet hakları: Siz ve Şirket, üçüncü bir kişinin Uygulamanın veya Uygulamaya sahip olmanızın ve Uygulamayı kullanmanızın kendi fikri mülkiyet haklarını ihlal ettiğini ileri sürmesi halinde, bu talebin araştırılmasından, savunulmasından, sulh yoluyla çözülmesinden ve sonuçlandırılmasından Apple’ın değil yalnızca Şirketin sorumlu olduğunu kabul edersiniz.
- Yasalara uyum: (i) ABD Hükümeti ambargosuna tabi olan veya ABD Hükümeti tarafından “terörü destekleyen” ülke olarak belirlenmiş bir ülkede bulunmadığınızı ve (ii) ABD Hükümeti’nin yasaklı veya kısıtlı taraflar listelerinden hiçbirinde yer almadığınızı beyan ve taahhüt edersiniz.
- Geliştirici iletişim bilgileri: Uygulamaya ilişkin sorularınızı, şikâyetlerinizi veya taleplerinizi hello@kitaplatform.com adresine e-posta göndererek veya kittap.app/support sayfası üzerinden Kita Platform LTD’ye iletebilirsiniz.
- Üçüncü taraf koşulları: Uygulamayı kullanırken, örneğin mobil veri hizmetinizin koşulları gibi, geçerli üçüncü taraf sözleşme koşullarına uymalısınız.
- Üçüncü taraf lehtar: Siz ve Şirket, Apple’ın ve Apple’ın bağlı şirketlerinin bu Sözleşmenin üçüncü taraf lehtarları olduğunu ve bu Sözleşmeyi kabul etmenizle birlikte Apple’ın, bu Sözleşmeyi üçüncü taraf lehtar olarak size karşı uygulama hakkına sahip olacağını (ve bu hakkı kabul etmiş sayılacağını) kabul edersiniz.
